Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Freya ("we," "us," "our," or the "Company") governing your access to and use of the Freya mobile application (the "App") and any related services.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.
2. IMPORTANT: Medical & Health Disclaimer
2.1 Not Medical Advice
THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
Freya is a skincare guidance and wellness tool designed to provide general information and personalized skincare recommendations. The App, including all content, features, skin analysis, skin scores, and product recommendations:
- Is for informational and educational purposes only
- Is NOT a substitute for professional medical advice, diagnosis, or treatment
- Should NOT be relied upon for medical decisions
- Does NOT constitute a dermatological consultation or medical examination
2.2 Analysis Limitations
The skin analysis feature provides estimates and general guidance only. You acknowledge and understand that:
- Analysis may not be accurate for all skin types, conditions, or lighting environments
- Skin scores and assessments are algorithmic estimates, not clinical diagnoses
- The App cannot detect or diagnose skin diseases, cancers, or medical conditions
- Results may vary and should not be considered definitive
2.3 Consult a Healthcare Professional
ALWAYS SEEK THE ADVICE OF A DERMATOLOGIST OR OTHER QUALIFIED HEALTHCARE PROVIDER with any questions you may have regarding:
- Any skin condition, rash, lesion, or abnormality
- Changes in moles, growths, or skin appearance
- Persistent or worsening skin concerns
- Allergic reactions or skin sensitivities
- Any medical condition affecting your skin
NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE or delay seeking it because of something you have read or seen in the App.
2.4 Emergency Situations
IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR EMERGENCY SERVICES IMMEDIATELY.
The App is not designed for emergency situations and should never be used to assess urgent medical conditions.
2.5 Product Recommendations
Product recommendations provided by the App:
- Are based on general ingredient analysis and your stated preferences
- May not account for all individual allergies, sensitivities, or reactions
- Do not guarantee safety, efficacy, or suitability for your specific skin
- Should be patch-tested before full application, especially for sensitive skin
We do not guarantee the accuracy of product information provided by third-party sources. Always verify product ingredients and consult a dermatologist if you have concerns.
2.6 Pregnancy & Health Conditions
If you are pregnant, breastfeeding, or have any medical condition:
- Consult your healthcare provider before using any skincare products
- The pregnancy-safe filtering feature is provided for general guidance only
- We cannot guarantee complete safety of any product for pregnant or nursing individuals
- Some ingredients may have varying recommendations from different health authorities
2.7 Assumption of Risk
By using the App, you acknowledge and accept that:
- You use the App and any recommendations at your own risk
- You are responsible for your own skincare decisions
- Results may vary and are not guaranteed
- We are not liable for any adverse reactions or outcomes
3. Eligibility & Account Registration
3.1 Age Requirements
You must be at least 13 years of age to use the App.
If you are between 13 and 18 years of age:
- You must have permission from a parent or legal guardian
- Your parent or guardian must review and agree to these Terms on your behalf
- Your parent or guardian is responsible for supervising your use of the App
We do not knowingly collect information from children under 13. If you are under 13, do not use the App or provide any information.
3.2 Account Creation
To access certain features, you must create an account by providing:
- A valid email address
- A secure password
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3.3 One Account Per User
Each user may maintain only one active account. Creating multiple accounts may result in termination of all accounts.
4. License Grant & Restrictions
4.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal mobile device
- Use the App for your personal, non-commercial purposes
4.2 Restrictions
You agree NOT to:
- Copy, modify, or distribute the App or any content
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App for any commercial purpose without authorization
- Attempt to gain unauthorized access to our systems
- Use automated scripts, bots, or scrapers
- Interfere with or disrupt the App's functionality
- Circumvent any security measures
- Use the App to violate any laws or regulations
- Impersonate any person or entity
- Upload malicious code or content
4.3 Intellectual Property
All content, features, and functionality of the App—including but not limited to text, graphics, logos, icons, images, software, and models—are owned by Freya or our licensors and are protected by copyright, trademark, and other intellectual property laws.
The "Freya" name, logo, and all related marks are trademarks of the Company. You may not use these marks without our prior written permission.
5. User Content & Conduct
5.1 Your Content
You retain ownership of any photos or content you upload to the App ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store and process your photos for analysis
- Display your routine and progress to you
- Improve our services (using anonymized/aggregated data only)
5.2 Accuracy of Information
You are responsible for ensuring that all information you provide—including survey responses—is accurate and truthful. Inaccurate information may result in inappropriate recommendations.
6. Subscription Services
6.1 Free & Premium Features
The App may offer both free features and premium subscription options. Subscription details, pricing, and features will be clearly displayed before purchase.
6.2 Subscription Terms
If you purchase a subscription:
- Billing: Payment will be charged to your Apple ID account at confirmation of purchase
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Price Changes: We may change subscription prices; you will be notified in advance
- Cancellation: You can cancel auto-renewal through your Apple ID Account Settings
6.3 Free Trials
If offered, free trials:
- Automatically convert to paid subscriptions unless cancelled
- Must be cancelled at least 24 hours before the trial ends
- Unused portions are forfeited upon subscription purchase
6.4 Refunds
Subscription payments are generally non-refundable. Refund requests are handled by Apple according to their policies.
6.5 Manage Your Subscription
To manage or cancel your subscription:
- Go to iPhone Settings > [Your Name] > Subscriptions
- Select Freya
- Choose your desired option
Deleting the App does not cancel your subscription.
7. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the App, you consent to our data practices as described in the Privacy Policy.
8. Account Deletion
You may delete your account at any time through the App or by contacting us. Upon deletion:
- Your personal information will be removed from our active systems
- Your photos and analysis data will be permanently deleted
- Some data may be retained as required by law
- Any active subscription will continue until its expiration (cancellation is separate)
To delete your account, go to Profile > Delete Account or contact us at support@freyaskincare.app.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of any content
- Uninterrupted or error-free operation
- Security of data transmission
We do not warrant that:
- The App will meet your requirements
- Results will be accurate or reliable
- Defects will be corrected
- The App is free of viruses or harmful components
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREYA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Any damages arising from your use or inability to use the App
- Any damages related to product recommendations or skin analysis
- Any adverse reactions to recommended products
- Any health-related outcomes
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Freya and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
- Any claim that your use caused damage to a third party
12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
12.2 Dispute Resolution
Any dispute arising from these Terms or your use of the App shall be resolved as follows:
- Informal Resolution: We encourage you to contact us first to resolve any dispute informally.
- Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Class Action Waiver: YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.
12.3 Exceptions
The following are not subject to arbitration:
- Claims in small claims court
- Injunctive relief for intellectual property infringement
- Claims related to imminent harm or illegal activity
13. Termination
13.1 By You
You may stop using the App and delete your account at any time.
13.2 By Us
We may suspend or terminate your access to the App at any time, with or without cause, including for:
- Violation of these Terms
- Fraudulent or illegal activity
- Harmful conduct toward other users
- Extended periods of inactivity
- Business reasons (with notice where practicable)
13.3 Effect of Termination
Upon termination:
- Your license to use the App terminates immediately
- You must cease all use of the App
- Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) shall survive
14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Freya regarding the App.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your rights hereunder. We may assign our rights and obligations without restriction.
14.5 Notices
We may provide notices to you through the App, by email, or by other means. You may contact us at support@freyaskincare.app.
15. Apple-Specific Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and Freya, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any claims related to the App
- Apple is not responsible for addressing any claims by you or third parties relating to the App or your possession/use of the App
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund; Apple has no other warranty obligation
- Apple is a third-party beneficiary of these Terms and may enforce them against you

17. Acknowledgment
BY USING THE APP, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms of Service
- You have read and understood the Privacy Policy
- You understand that Freya is NOT a medical service
- You understand analysis results are estimates only
- You will consult healthcare professionals for medical concerns
- You use the App and its recommendations at your own risk
